B2C Booking Terms - Lookster

These booking terms apply to the use of the Lookster platform for making appointments at salons and beauticians.

1. Definitions

  1. "Lookster", "we", "us": Lookster, Chamber of Commerce 94593051, Piet Heinstraat 12, 7511JE Enschede.
  2. "Platform": the Lookster Website (www.lookster.nl), App(s), and all booking interfaces offered by Lookster (or on behalf of Lookster).
  3. “Distribution Channels”: external channels/third party technology through which a Booking can be placed via Lookster (e.g. Partner pages, “Book with Google”, maps or integration partners), to the extent that the booking is processed via Lookster infrastructure.
  4. "User", "you": the natural person who requests/books an appointment via the Platform.
  5. "Salon" or "Partner": the (third) provider of services that is visible via Lookster and with which you can book an appointment.
  6. “Services”: the services offered by a Salon (e.g. hair, beauty or massage treatments).
  7. “Booking” means an appointment placed via Lookster for a specific date and time at a Salon (whether placed via Website/App/Partner Page/Distribution Channels/or other booking interfaces offered by Lookster).
  8. "Booking Confirmation": the confirmation (on the Platform and/or by email) that your Booking has been registered or accepted.
  9. "Gift Voucher" or "Credit": a voucher or credit issued by Lookster (digital or otherwise) that, if activated by Lookster, can be used via the Platform to pay (part of) the price of Services under the conditions in Article 7.

2. Role of Lookster and contracts

  1. Lookster is a technical platform/marketplace. You can make a Booking at a Salon via Lookster. Lookster does not provide salon treatments itself.
  2. Agreement with the Salon. When you make a Booking, the agreement for performance of the Service is concluded between you and the Salon. The Salon is responsible for performance, quality, safety, hygiene, prices, availability and the handling of complaints about the Service.
  3. No selection/control. Salons can (in principle) register on Lookster. Lookster does not systematically check Salon information (such as Chamber of Commerce, permits or certifications). Use of Salon information is at your own risk, within the limits of consumer law.

3. The booking process

  1. You make a Booking by choosing a Salon and selecting a Service/date/time and filling in the requested details (with account or as a guest).
  2. Booking confirmation. After placing the Booking you will receive a Booking Confirmation (where available). Depending on the Salon, a Booking may be immediately confirmed or may first have to be accepted by the Salon.
  3. Correct data. You are responsible for completing your contact details correctly.

4. Cancellation, changes and no-show

  1. Salon policy governs. Canceling and changing a Booking is done in accordance with the Salon's cancellation and change policy. This policy may differ per Salon.
  2. Where possible we show the salon policy in the Platform. If the policy is not in the Platform, the Salon may communicate the policy to you in some other way (e.g. by email/message). You are responsible for reading and complying with this policy.
  3. How to cancel/change. You can cancel or change (depending on availability):
    1. via your Lookster account in the Platform;
    2. via a link or function in the Booking Confirmation; and/or
    3. directly at the Salon.
  4. Time-specific services and right of withdrawal. For services that must be performed on a specific date or period (such as a salon appointment), there is generally no legal right of withdrawal for "distance contract". You therefore cancel in accordance with the Salon's policy, unless mandatory law determines otherwise.
  5. No-show/late arrival. If you do not show up or are late, the Salon may charge a fee or cancel the appointment (partially) according to its policy. Lookster does not determine this policy.

5. Prices and payment

  1. Prices. The Salon determines the price of the Services and any surcharges. The price shown at the time of booking prevails, unless there is an obvious error.
  2. Payment on location. Lookster currently does not facilitate online payments, unless expressly stated otherwise on the Platform. Payment usually takes place at the Salon according to the Salon's payment options.
  3. Invoices and VAT. The Salon is responsible for invoicing and VAT (if applicable). In the current situation, Lookster cannot provide a VAT invoice for the salon treatment.

6. Future online payments

  1. Lookster may in the future introduce features such as online payment in advance, deposits, no-show fees, cancellation fees or refunds through the Platform.
  2. If such features are introduced, additional (payment) terms and conditions may apply and an external payment provider may be used.
  3. In that case, Lookster (or a payment provider engaged by Lookster) may process payments on behalf of the Salon (e.g. as an authorized payment collection agent), and procedures may apply for refunds, chargebacks and fraud prevention. These rules apply only once they are published on the Platform and accepted by you when using the payment function.

7. Gift vouchers and credits

  1. General. Lookster may offer Gift Vouchers/Credits. If and when Lookster activates Gift Vouchers/Credits, the provisions in this article apply. If a specific promotion or Gift Voucher has additional conditions (e.g. discount promotions, minimum spend, validity period), those additional conditions apply in addition to this article.
  2. Form and delivery. Gift vouchers/credits can be issued digitally (e.g. by email or in-app) or in any other manner that Lookster mentions on the Platform. Lookster may request an account to manage or use a Gift Voucher/Credit.
  3. Usage. A Gift Voucher/Credit can (only) be used on the Platform, in the manner and for the Services that Lookster indicates on the Platform. A Gift Voucher/Credit:
    1. cannot be exchanged for cash;
    2. cannot be used to purchase another Gift Voucher unless Lookster explicitly allows this;
    3. cannot be transferred or resold for commercial purposes unless expressly permitted by Lookster.
  4. Validity and expiry date. Gift vouchers/credits may have a validity period or expiry date. The validity period/expiry date is stated (where applicable) upon issue or in the Platform. After the expiration date, the credit may expire (in whole or in part), to the extent permitted by law.
  5. Loss, theft and abuse. You are responsible for carefully managing codes, emails and access to your account. Lookster is not liable for loss, theft or unauthorized use of a Gift Voucher/Credit, unless caused by an attributable breach by Lookster. Lookster may block or refuse Gift Vouchers/Credits in the event of (suspected) fraud, abuse or unlawful use.
  6. Return/refund. If you purchase a Gift Voucher/Credit, a statutory right of withdrawal may apply (e.g. when purchasing at a distance), unless a legal exception applies. If cancellation/refund is possible:
    1. this only applies to the unused part; and
    2. refund will be made via the original payment method or in another legally permitted manner.
    3. Lookster may refuse a request if the Gift Voucher/Credit has been (partially) used or if the law allows this.
  7. No guarantee of availability of payment function. The fact that Lookster may offer Gift Vouchers/Credits (future) does not mean that every Salon, Service or payment method will always be available for use with a Gift Voucher/Credit.

8. Information about Services and Responsibility

  1. The Salon is responsible for the accuracy of its offer, availability, photos, descriptions, prices and conditions.
  2. You are responsible for reporting relevant medical/health information (such as allergies, pregnancy, skin problems, medication, injuries) to the Salon before the appointment.

9. Reviews, rankings and content

  1. Reviews. Where available, users can leave reviews/ratings about Salons and/or Services. Reviews are personal opinions of users.
  2. Moderation. Lookster may moderate, hide or remove reviews or other content if necessary (e.g. abuse, spam, hate/threats, unlawfulness or violation of policy).
  3. Ranking. Search results can be ranked based on multiple factors (e.g. relevance, distance, popularity, availability, and other quality or usage signals). Filters may be available to adjust sorting.

10. Complaints and disputes about a Service

  1. Complaint to the Salon. Complaints about the performance of the Service must first be submitted to the Salon.
  2. Contact Lookster. You may also contact Lookster via [email protected]. Lookster may forward the complaint to the Salon and attempt to mediate (without obligation), but is not responsible for the outcome and is under no obligation to provide a refund or compensation, unless Lookster itself is legally liable.

11. Liability

  1. Lookster is not liable for damage arising from or related to:
    1. the performance of the Service by the Salon;
    2. acts or omissions of the Salon;
    3. Salon conditions (such as cancellation/no-show);
    4. incorrect or incomplete information posted by the Salon.
  2. To the extent that Lookster is liable, Lookster's liability is limited to direct damage and up to a maximum of EUR 100 per event, unless mandatory law prescribes a higher liability.
  3. Nothing in these Booking Terms excludes or limits liability for intent or deliberate recklessness on the part of Lookster or for liability that cannot be excluded under mandatory law.

12. Changes

We may change these Booking Terms. The most current version is on the Platform. In the event of material changes, we will (reasonably) announce them in advance via the Platform and/or by e-mail.

13. Applicable law and competent court

Dutch law applies. If you are a consumer residing in the EU, you retain the protection of the mandatory consumer-law provisions of your country of residence. Disputes may be submitted to the competent court; for consumers, the court of their place of residence may also have jurisdiction where mandatory law so provides.
