UGC terms

1. UGC is any content posted or submitted to the Platform by a user or partner, including:
   1. Reviews/ratings by consumers (Users);
   2. Portfolio/salon content by Partners (such as photos and videos, salon information or similar content), to the extent posted via functions in the Platform.
2. UGC may be visible to other users, Partners and/or visitors to the Platform.

1. Users (consumers): can (where available) post reviews/ratings with their account name.
2. Partners (salons): can (where available) post portfolio content, such as photos and videos.
3. Lookster may limit, change or (temporarily) disable certain UGC functionalities.

1. UGC is currently posted under your account name.
2. Lookster may introduce features in the future that allow certain contributions to be displayed (partly) anonymously. If that happens, Lookster may publish additional rules.

1. You are responsible for your UGC and for the consequences of its publication.
2. Post UGC only:
   1. that you can post (you have the rights/permissions), and
   2. that complies with this UGC policy and the law.
3. Preferably, do not post sensitive information. In any event, do not include special categories of personal data (such as medical data) about yourself or others in UGC.

If you post a review or rating:

1. Your review must be based on your own, genuine experience with the salon/service.
2. You may not post a misleading review (e.g. pretending that you were a customer when you are not).
3. No spam or advertising (e.g. links, promotions, codes).
4. No blackmail or threats (e.g. "if I don't get a discount I will put 1 star").
5. Conflict of interest: If you have a connection with the salon (e.g. you work there, family, sponsor), please state this clearly or do not post a review.

If Partner posts UGC (such as photos or videos):

1. You only post content that fits the professional presentation of your salon and services.
2. You warrant that your content is current and does not misrepresent:
   1. services, results, prices, availability or promotions;
   2. "discounts" (not fake discounts or misleading claims).

UGC may not:

1. be unlawful, abusive, discriminatory, hateful, threatening or harassing;
2. be defamatory or unlawfully damaging to another's reputation;
3. contain or exploit sexual content, or content involving minors in an inappropriate manner;
4. glorify violence or incite illegal activities;
5. be misleading or knowingly contain false information;
6. contain spam/advertising or repeatedly post the same content ("flooding");
7. contain malware/viruses or other harmful code;
8. infringe intellectual property rights (copyright/trademarks), privacy rights or portrait rights of others;
9. contain personal data of others without necessity and consent (e.g. telephone numbers, addresses).

1. You warrant that you have all necessary rights and permissions for your UGC, including (where relevant) copyright, trademark rights and portrait rights.
2. Recognizable people in the picture (photo/video):
   1. You do not post photos/videos with recognizable people without valid permission or other valid basis.
   2. If there are recognizable minors in the picture, there must be permission from a parent/guardian, where required.
3. Lookster may ask you for proof of consent (e.g. model release) if there is a concrete reason for this (e.g. complaint).

1. By posting UGC, you grant Lookster a non-exclusive, worldwide, royalty-free license to:
   1. host, store and display on the Platform;
   2. process technically (e.g. resize, compress, create thumbnails, or add subtitles/formatting for display);
   3. use for moderation, security, enforcement, support and improvement of the Platform.
2. Marketing outside the Platform:
   1. For Partner portfolio content (photos/videos), Lookster may also use this content for promotion/marketing of Lookster and/or the Partner (e.g. social posts, advertisements, newsletters), to the extent that this fits within the licensing agreements in the Partner Terms.
   2. For consumer reviews/ratings Lookster does not use individual review texts or account names in paid marketing outside the Platform without your permission. Lookster may show anonymized or summarized statistics (e.g. "average rating 4.6/5"), where permitted.
3. Duration: the license applies as long as your UGC remains on the Platform and thereafter for a reasonable period necessary for technical processing (such as caching, backups and archiving), to the extent permitted by law.

1. Lookster may refuse, hide, edit or remove UGC (in whole or in part) if this is reasonably necessary, for example:
   1. violation of this UGC Policy or the Terms of Use;
   2. complaints about infringement/unlawfulness;
   3. spam, abuse or security risks;
   4. protect the reputation or quality of the Platform.
2. Lookster is not obliged to check UGC in advance.
3. For repeated or serious violations, Lookster may limit or block accounts, or (temporarily) limit partner accounts, in accordance with the applicable terms and conditions.

1. Do you think UGC is unlawful or against this policy? Report this via the support page or by email [email protected] with subject: "UGC report" and include:
   1. link/description of the content (and a screenshot if possible);
   2. why you think it is not allowed;
   3. (optional) evidence/context.
2. Lookster will assess reports as quickly as reasonably possible and can take appropriate measures.

Lookster may share information about a user or partner with competent authorities or third parties if Lookster is legally obliged to do so (e.g. court order) or if this is necessary to investigate or address (suspected) fraud, abuse or infringements, within the limits of applicable privacy legislation.
